1. General Provisions, Customers, Contract Language
(1) These General Terms and Conditions apply to all quotations, orders, purchase contracts and deliveries concluded via our online store or by any other means.
(2) Our offering is directed to both Consumers and Business Customers.
A Consumer means a natural person who enters into a transaction wholly or predominantly for personal, domestic or household purposes, within the meaning of the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
A Business Customer means any natural person, body corporate or partnership entering into a transaction for the purposes of their trade, business or enterprise activity.
(3) Any conflicting or additional standard terms submitted by the Customer shall not form part of the contract, even if we do not expressly object to them in individual cases. This clause does not exclude or restrict any statutory rights conferred by Australian law which cannot be contractually modified or excluded.
(4) The contract is made in the English language.
2. Conclusion of Contract
(1) The offers displayed in the online shop are subject to change and non-binding.
(2) The customer can select products and place them in the virtual shopping cart. Via the checkout process, after entering the required data and selecting the payment and shipping method, the customer submits a binding purchase offer by clicking the order button.
Before submitting the order, the customer can review and change their details at any time. The order can only be completed if the Terms & Conditions and the Privacy Policy are accepted.
(3) After submitting the order, the customer receives an automatic order confirmation by email. This does not yet constitute acceptance of the offer.
The contract is only concluded through an express declaration of acceptance, by shipment of the goods, or by a payment request – the earliest point in time shall be decisive.
3. Delivery and Product Availability
(1) Delivery times begin at the time of order confirmation, provided the purchase price has been paid in advance. Unless otherwise stated, the delivery time is up to 32 business days.
(2) Should an item be permanently unavailable, no contract is concluded.
(3) In the event of temporary unavailability, the customer will be informed immediately.
(4) Additional costs outside our control (e.g., bank fees, exchange rate costs, customs duties or import VAT) are to be borne by the customer. The goods are generally shipped uncleared by customs and untaxed.
4. Prices and Payment Terms
(1) All prices are exclusive of shipping costs.
(2) Delivery is generally made only against advance payment. Accepted payment methods are displayed during the ordering process.
(3) The purchase price is due immediately upon conclusion of the contract. If the customer falls into payment default, we reserve the right to assert statutory default interest and further damages.
5. Shipping
Shipping is handled by a postal or parcel service provider.
For consumers, we bear the shipping risk. In the event of a failed delivery for which the customer is responsible, a reasonable processing fee may be charged. In order to always be able to offer you the latest version of our products, some shipments are sent directly from our international logistics network.
Packaging and product labeling may therefore differ from the shop name.
Of course, you will always receive the product you ordered in inspected quality.
6. Warranty
(1) The statutory warranty rights apply.
(2) An additional guarantee exists only if it has been expressly promised.
(3) Consumers are asked to report obvious transport damage immediately. Failure to report does not affect statutory rights.
7. Liability
(1) Claims for damages are excluded to the extent legally permissible.
This does not apply to damages resulting from injury to life, body or health, or in cases of intent or gross negligence.
(2) In cases of simple negligence, we are only liable for breaches of essential contractual obligations and limited to the foreseeable damage.
(3) The limitations of liability also apply in favor of our legal representatives and vicarious agents.
8. Right of Withdrawal
Consumers have a statutory right of withdrawal for distance contracts. Details can be found in the separate withdrawal policy.

(1) Personal data is all information relating to an identified or identifiable person, e.g., name, address, email address, payment and order data.

(2) Personal data is processed exclusively for contract processing, delivery, billing and customer communication.

(3) Data is only transferred insofar as this is necessary for contract fulfillment (e.g., shipping or payment service providers).
(4) We implement appropriate technical and organizational security measures to protect personal data.
(5) Data is only stored for as long as necessary for the respective purposes or statutory retention periods.

11. Applicable Law and Place of Jurisdiction
(1) The law of the Hong Kong Special Administrative Region of the People's Republic of China applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
